The short answer

The5ers sells forex evaluations, instant accounts and futures from two companies of the same name in the UK and Israel, and its terms are governed by Israeli law. Its terms let it forfeit your profits for posting “disparaging” statements about it on a review site. A video interview it requests must be scheduled and completed within 5 business days or every account is canceled. Every cash payout carries a 3.5% commission, and a single High Stakes payout is capped at $3,000 on a $50,000 account and $4,000 on a $100,000 one.

How it works

The5ers’ forex programs differ mainly in what happens at the daily limit. The table shows the main routes.

ProgramBefore fundingProfit targetDaily limitMaximum loss
High Stakes2 steps10%, then 5%5%, ends the account10%, static
Pro Growth1 step10%3%, ends the account6%, static
Hyper Growth1 step, no minimum days10% to scale3% pause6%, static
Bootcamp3 steps6% in each stepNone, then a 3% pause once funded5%, then 4% once funded
  • The daily limit on High Stakes and Pro Growth is taken from the higher of your balance or equity at the start of the trading day, and hitting it ends the account. The Daily Pause on Hyper Growth and on the funded Bootcamp account is measured the same way from midnight GMT+3, but it only closes your open trades and reopens the account the next day.
  • High Stakes and Pro Growth need 3 profitable days of at least 0.5% of the starting balance. Hyper Growth has no minimum.
  • Bootcamp’s size is the destination. The $20,000 route starts on a $5,000 account and passes through $10,000 and $15,000.
  • No forex program has a time limit, but the program pages expire an account after 30 days with no new trade. On High Stakes the count starts on the day you register, and a funded High Stakes account gets 60 days.
  • A Summer Plan is also on sale, with $100,000 and $200,000 accounts, a 50% consistency rule and payout caps of $2,000 and $3,000.

Here is what High Stakes asks on a $100,000 account. Step 1 needs $10,000 of profit and step 2 needs $5,000, each with at least 3 profitable days of $500 or more. Equity must stay above $90,000 at all times. The daily limit is 5% of the higher of the previous day’s closing balance or equity, which is $5,000 on the first day.

The funded High Stakes account keeps some evaluation rules. Each scaling step asks for 10% profit and 3 more profitable days, a funded account expires after 60 days without a trade (so says the High Stakes FAQ; the page’s Guidelines block gives 30 days without naming a stage), and oil leverage on funded $50,000 and $100,000 accounts is 1:5 until further notice.

The5ers Futures is a separate line with two one-step programs, Day Trade and Swing, sold by buying power from $25,000 to $150,000. Both ask for a 6% evaluation target, and the 4% maximum loss trails your highest midnight balance or equity instead of staying fixed. Day Trade positions must be closed at least 10 minutes before the market close, Swing may hold a small number of contracts overnight, capped by account size, and neither may hold into the weekend.

What it costs

The price box on this page lists entry fees by program and account size. Four costs sit outside that fee:

  • Bootcamp is paid in two parts: $95 to start and $205 on passing for the $100,000 route.
  • Fee refunds come back in pieces. On High Stakes, 70% returns with your first payout, and Hub credits are added as you pass each step. Credits cannot be cashed and expire after 3 months.
  • cTrader costs $10 more on forex, and Black Arrow Plus costs $30 more than Black Arrow One on futures. Neither platform choice can be changed after purchase.
  • Forex commission is $4 a lot round trip; indices carry none.

The refund window depends on which document you read. The FAQ says 14 days; the Terms say “Within 5 days of purchase: You may request a full monetary refund. After 5 days from purchase: You may request a refund in the form of Hub Credit only.” Either way the Terms allow a refund only if you have not traded and have not breached them, and the Terms take precedence over the FAQ, so treat the window as 5 days for your money back and Hub credit after that.

Platforms and trading conditions

The5ers offers MetaTrader 5, cTrader and TradingView for forex, but US residents can use TradingView only, and futures run on BlackArrow.

  • Leverage on forex pairs is 1:100 on High Stakes and 1:30 on Growth and Bootcamp.
  • High Stakes cannot open trades 2 minutes either side of high-impact news in the related currency or index. Profit from such a trade is deducted and a loss stays with you.
  • Hyper Growth and Bootcamp allow news trading, but not bracket orders placed around a release.
  • Overnight and weekend holds are allowed on forex, with high swaps on indices and oil at the weekend.
  • Expert advisors are allowed only if you own the source code, and the Terms require written approval first.
  • Futures market data is included in the program fee, and BlackArrow is the only futures platform.

The rules that matter

The5ers publishes its trading limits in detail. Four rules in its Terms and payout policy decide what a funded trader keeps.

What you say about The5ers

The Terms list “defamatory, disparaging, or harmful statements” about the company on review sites, forums or social media as grounds for termination, and publishing your support tickets or emails with it without its authorization counts too. The firm can then end the account with no refund, and accrued profit is forfeited.

The Termination for Cause clause reaches your correspondence with the firm as well as your opinion of it:

“You make any defamatory, disparaging, or harmful statements about the Company, its employees, or the Services on any public platform, including but not limited to social media networks, public groups, forums, or review sites. This includes a strict prohibition on the unauthorized disclosure, sharing, or publication of any internal correspondence, support tickets, or private communications between You and the Company (including, without limitation, emails, chat logs, or messages with our Support, Risk, Tech, or Compliance teams) on any social media or public platform. Violation of this clause constitutes a fundamental breach of these Terms, granting the Company the right to immediately terminate Your Account(s) and block Your access to the Services without any refund of fees paid (including Evaluation fees), and any accrued profits or Reward Balance shall be immediately forfeited.”

A 5-day interview deadline

The5ers may request a video interview at any point in verification. It must be both scheduled and completed within 5 business days. If not, pending payouts are denied, all your accounts are canceled and the relationship ends. The Terms tie verification to anti-money-laundering and fraud checks but do not say what prompts an interview.

The deadline and what follows from missing it are both in the Client Verification Process clause:

“If the Company requests an interview, both the scheduling of the interview and the conduct of the interview itself must take place within five (5) business days from the date of the request. Failure to successfully schedule and complete the interview within this strict timeframe will result in the denial of any pending payouts, immediate cancellation of all associated accounts, and termination of the collaboration.”

What a payout costs on a $100,000 High Stakes account

Each payout is capped at $4,000 and needs at least $500 of profit. A 3.5% commission comes off every cash payout, so a $4,000 payout arrives as $3,860 by Rise or bank transfer. You can request one every 14 days.

Forfeiture for residence, found at any stage

If The5ers finds at any stage, including after you are funded, that you live in a restricted country, the firm can close the account, and on that closure all fees are kept and all profit is voided. Residence is declared at signup and checked at identity verification, after payment.

The Prohibited Jurisdictions clause says the check can come at any stage, including after the KYC process:

“You declare that you do not reside in a prohibited jurisdiction or one subject to sanctions. […] If, at any stage (including during or after the KYC process), it is discovered that you have violated the prohibition against circumvention or are a resident of a forbidden/sanctioned territory, the Company is entitled to close your account immediately. In the event of termination due to this breach, you are not entitled to any financial refund for fees paid (including Evaluation fees). Any accrued balance of profits or rewards shall be canceled and forfeited, and you waive any future claim against the Company regarding this termination.”

Getting paid

The futures split is a fixed 80%. On forex, the split depends on the program and rises as the account scales:

  • High Stakes: 80%, rising to 100% at $350,000 with a $4,000 monthly fixed payout, and $10,000 a month at $500,000.
  • Pro Growth: 75%, scaling to 100%. Hyper Growth: 50% at first, 75% once funded. Bootcamp: 50% rising to 100%.
  • You can request a payout every 14 days: the first 14 days after the funded account opens, then 2 weeks after the last approved one. Scaling resets that clock.
  • Payouts go by Rise, bank transfer or crypto, all with a 3.5% commission, or as Hub credits with none. Crypto payouts are limited to $1,500.
  • Accounts scale on each 10% target, or 5% on Bootcamp: High Stakes up to $500,000, Growth and Bootcamp up to $4,000,000.

The High Stakes split steps up as the account grows: 85% at $175,000, 90% at $250,000 and 100% at $350,000. On a $50,000 account each payout is capped at $3,000 and needs at least $300 of profit. The 70% fee refund with the first payout also needs $150 of profit and 14 days of activity. The5ers says approved payouts are typically processed within 3 business days.

What can end your account

These rules can end an account at The5ers. Each comes from its own FAQ and Terms:

  • Touching the daily limit on High Stakes or Pro Growth, or the maximum loss on any program.
  • High-frequency trading, arbitrage, tick scalping or bracket orders around news.
  • Sharing trades with another trader, or an EA whose trades other traders also hold.
  • Missing the interview deadline or paying with a card not in your name.
  • Statements about the company on review sites that it considers disparaging.
  • 30 days without a new trade, or 60 days on a funded High Stakes account.
  • A futures position left open into the weekend, past the 4:50 PM ET cut-off.

Some rules close an account without any trading loss. A card that is not in your name disables the account, and while the firm allows several devices and IP addresses from one primary location, it forbids executing trades from two IP addresses at the same time. Copying trades between your own accounts is allowed within program limits, such as a different strategy on each Bootcamp account; copying another trader is not.

Who can join

The5ers’ FAQ lists 35 places where it does not accept traders, and the firm adds rules on who may trade:

  • Restricted places include Russia, Belarus, Iran, Venezuela and Donetsk, Luhansk, Kherson and Zaporizhzhia.
  • Israel is on the list, although one of the two companies behind The5ers is registered there.
  • US residents may join but can trade forex on TradingView only.
  • You must use one email address, and any card you pay with must be in your own name.

Who you are dealing with

The5ers’ Terms name two companies with the same name, and never say which of them you are contracting with. The table records each registration as the Terms give it, with the law The5ers chooses and the person it puts at the top.

  • The Terms do not say which of the two companies does what.
  • The Terms can change at any time, effective on posting, with no notice.
  • The5ers describes itself as a private equity fund that owns a forex trading account connected to regulated liquidity providers, which it does not name, and says no regulation clause applies to what it does because it is not a financial institute.

One disclosure belongs here, because it changes what a comparison is worth. The stocks firm Trade The Pool, which we also review, is the same operator: its Terms name Five Percent Online Ltd. as the contracting party, the name both of The5ers’ registrations carry. Setting the two side by side compares one company with itself, so we do not put Trade The Pool forward as an alternative to The5ers.

Its Trustpilot profile scored 4.7 across 36,250 reviews on 27 August 2026, with 90% at five stars against 3% at one. Trustpilot marks the profile as one that invites its customers to review it. None of those reviews stands in for a tested payout.

Why this grade

The price is strong and the trading conditions good at The5ers, yet two terms hold its letter well below its score: one claws back rewards if you publish your correspondence with the firm, the other takes accrued profit over critical reviews. Payouts and support carry no score.

Part and scoreThe reason
Rule fairness (20% of the grade)
33/100 · Weak
A funded trader can be made to repay every reward for publishing emails with the firm, one of two terms capping the grade, and missing a five-business-day interview window forfeits pending payouts.
Trading conditions (20% of the grade)
80/100 · Good
The maximum loss on a typical The5ers plan is fixed and news trading and holding are allowed; a profit target above that loss and a daily loss limit cost some points.
Company trust (15% of the grade)
65/100 · Fair
Posting an accurate but critical review or a support chat is a fundamental breach that forfeits accrued profit, the second term capping the grade, and the funded contract cannot be read before paying.
Challenge value (15% of the grade)
90/100 · Strong
The $250,000 Bootcamp costs $225 up front plus $350 on passing, which works out at $2.30 per $1,000 of funded capital.
Payout reliability (25% of the grade)
Not scored
Nobody has yet followed a The5ers payout from purchase to bank, and no public payout records for it have been checked, so this factor is left out rather than scored.
Support (5% of the grade)
Not scored
The5ers' support has not been put to a test, and the same is true of every firm graded so far.

Accurate?

Our verdict

The5ers offers a long track record, static loss limits and scaling to large accounts, but a clause against disparaging reviews, a 5-day interview deadline and a commission on every cash payout limit what a funded trader keeps.

Best for

  • Traders who want a static floor and time to pass.
  • Hyper Growth or Bootcamp traders who want a daily pause rather than a breach.
  • Traders who plan to scale over many months.

Avoid if

  • You want to post openly about your experience with the firm.
  • You cannot guarantee a video interview within 5 business days.
  • You trade around news on High Stakes.

Questions traders ask

What is the difference between Pro Growth and Hyper Growth?

What happens at the 3% daily limit, and how you start. On Pro Growth, hitting it ends the account, and you pass a 10% evaluation with 3 profitable days first. Hyper Growth is sold as instant funding: hitting the limit closes your trades and pauses the account until the next day, and the split starts at 50%.

Is the maximum loss static or trailing?

Static on High Stakes, Pro Growth and Hyper Growth. High Stakes allows 10% below the initial balance, and the two Growth programs 6%. The5ers Futures is different: its 4% limit trails your highest midnight balance or equity.

Is there a time limit?

No. But an evaluation account with no new trade for 30 days expires, and on High Stakes that count starts on the day you register; a funded High Stakes account gets 60 days. High Stakes and Pro Growth also need 3 profitable days to pass.

Does the evaluation limit change once I am funded?

Not on High Stakes, Pro Growth or Hyper Growth: the maximum loss and daily limit stay the same. Bootcamp changes: its funded account has a 4% maximum loss and adds a 3% daily pause.

Is Bootcamp’s entry fee the whole cost?

No. You pay part up front and the rest on passing: $22 and $50 for the $20,000 route, $95 and $205 for $100,000, and $225 and $350 for $250,000.

Are the futures products the same as the forex ones?

No. The5ers Futures runs on BlackArrow, with a 6% evaluation target and a 4% trailing limit. The firm’s own pages disagree on the funded target: 4% at $25,000 on the public futures page, 10% at $50,000 in the Hub. The consistency rule is also described two ways: the futures pages and checkout cap any single position at 40% of your profit, while the general calculation page measures your best day against total profit. Day Trade positions must be closed at least 10 minutes before the market close, and neither program can hold over the weekend.

30 consecutive days without trading activity expires the account. Both pages state it, and the High Stakes page adds a detail the Growth page omits: the counter starts from REGISTRATION day, not from the first trade.

Bootcamp Evaluation · Funded Varies

More than 30 consecutive days without activity closes the account.

High Stakes New, High Stakes Classic Funded Varies

A funded High Stakes account expires after 60 consecutive days without trading activity; evaluation accounts get 30, counted from registration. The High Stakes FAQ states it; the page's Guidelines block still says 30 without naming a stage.

Up to $500K in total per trader, with at most one $150K, two $100K and five $25K or $50K accounts combined. The general-rules FAQ says instead 'Up to five Futures accounts can be traded simultaneously'. Both are the firm's own words and they do not agree.

Max daily loss 5
Futures Day Trade, Futures Swing Evaluation · Funded 3%

2.5% at $100K and $150K only; the $25K and $50K tables carry no daily loss row. Reaching it permanently terminates the account.

Bootcamp Funded 3%

3% on the funded account only; the three steps have no daily limit ('–'). Hitting it closes open trades and pauses the account until the next trading day, measured from the higher of balance or equity at 00:00 GMT+3. It is a pause, not a termination.

High Stakes New, High Stakes Classic Evaluation · Funded 5%

5% at all three stages, measured against the HIGHER of the previous day's closing balance or equity and fixed at 00:00 server time. Breaching it TERMINATES the account.

Hyper Growth Evaluation · Funded 3%

3% at every stage, evaluation and funded: the same figure as Pro Growth, but here the firm calls it 'Daily PAUSE' rather than 'Daily Loss'. Hitting it closes open trades and disables the account until 00:00 GMT+3; the account is NOT terminated. The firm's own two names signal that the same percentage carries a different consequence, and that is what the roughly five-times price buys.

Pro Growth Evaluation · Funded 3%

3%, which the firm calls 'Daily Loss' on Pro Growth, measured against the HIGHER of the start-of-day balance or equity. Breaching it TERMINATES the account – the same percentage as Hyper Growth and Bootcamp, with a permanent consequence instead of a pause.

Max overall loss 5
Bootcamp Evaluation 5%

5% on each of the three steps. It is static: the firm's own worked example keeps the floor at $9,500 on a $10,000 step after the account rises to $10,300.

Bootcamp Funded 4%

4% on the funded account, tighter than the 5% on the steps. The firm does not show how the funded 4% is measured, so its basis is not stated here.

Futures Day Trade, Futures Swing Evaluation · Funded 4%

4% at both stages, at every size, labelled 'Drawdown Type: EOD'. The firm does not say whether the EOD limit follows the balance up, so the basis is not asserted. The general-rules FAQ calls the same 4% a 'Maximum daily loss (EOD)', but lists the 2.5% daily limit separately, and the futures FAQ calls the 4% a maximum drawdown.

Pro Growth, Hyper Growth Evaluation · Funded 6%

6%, which the firm calls the 'Stop Out Level'. The firm states the same parameters apply on the funded stages. It is static: the firm states the maximum loss as a percentage of the initial balance and calls it "absolute drawdown". It does not trail equity.

High Stakes New, High Stakes Classic Evaluation · Funded 10%

10% at all three stages. It is static: the firm states the maximum loss as a percentage of the initial balance and calls it "absolute drawdown". It does not trail equity.

Max position size
Futures Day Trade, Futures Swing Evaluation · Funded Varies

2 minis or 20 micros at $25K, 4/40 at $50K, 8/80 at $100K and 12/120 at $150K, the same on Day Trade and Swing. Each scale-up adds 1 mini and 10 micros.

Minimum trading days 5
High Stakes New, High Stakes Classic Evaluation · Funded Varies

3 per step, and 3 again on the funded account to qualify for scaling.

Hyper Growth Evaluation · Funded Varies

None at either stage. The second thing the higher Hyper Growth price buys.

Pro Growth Evaluation Varies

3 in the evaluation, none shown on the funded stage.

Bootcamp Evaluation Varies

The5ers Bootcamp: the firm states no minimum trading days.

Futures Day Trade, Futures Swing Evaluation · Sim funded Varies

The5ers Futures Day Trade, The5ers Futures Swing: the firm states no minimum trading days.

News trading 2
Bootcamp Evaluation · Funded Varies

News trading allowed, except bracketing: placing a buy stop and a sell stop together around the release.

Futures Day Trade, Futures Swing Evaluation · Funded Varies

News trading allowed on both futures programs.

Overnight weekend holding 3
Bootcamp Evaluation · Funded Varies

Overnight and weekend holding allowed; the firm warns that indices held over the weekend carry very high swaps.

Futures Day Trade Evaluation · Funded Varies

No overnight holding: every position must be closed at least 10 minutes before market close. The 'No weekend holding' tab sets the cut-off at 4:50 PM ET and says failing it terminates the account. The program FAQ gives 4:50 PM CET instead of ET. What missing the weeknight close triggers is not stated separately.

Futures Swing Evaluation · Funded Varies

Overnight holding allowed within a smaller limit than the daytime size: 1 mini or 10 micros at $25K and $50K, 2/20 at $100K, 3/30 at $150K. No weekend holding: the 'No weekend holding' tab requires every position closed by 4:50 PM ET, 10 minutes before market close, or the account is terminated.

Profit split scaling 4
Bootcamp Funded Varies

Starts at 50/50 on the funded account, 75/25 from the first scale-up, 80/20 at $2M and 100/0 from $2.5M, with a scale-up on every 5% target up to $4M. 'Up to 100%' in the table is the top of that ladder, not where the account opens.

Futures Day Trade, Futures Swing Funded Varies

A fixed 80/20 that never improves. The account itself scales: every 10% target adds 5% buying power and 1 mini and 10 micros, up to $500,000.

Pro Growth Funded Varies

A conflict on one page. The specification table reads 'Up to 100%' and the headline says 'Up to 100% profit share', while the plan detail on the same page states '75%/25%', which is where the account actually OPENS. Both figures are the firm's own.

High Stakes New, High Stakes Classic Funded Varies

Profit share 80%-100%. The firm states the limit on concurrent accounts as a mix of account sizes rather than a single number, totalling 4 in one case and 11 in the other. The page does not make clear which account type each applies to.

Profit target 4
Bootcamp Evaluation · Funded Varies

6% on each of the three steps, then 5% on the funded account, where hitting it scales the account. Each step starts on its own smaller balance, so a 6% step-1 target on the $20K route is $300.

Futures Day Trade, Futures Swing Evaluation · Funded 6%

6% in the single evaluation phase, which can be passed in one day. The funded stage shows 4%, the profit a funded account needs before a payout.

Pro Growth, Hyper Growth Evaluation 10%

10% on both Growth programs, called 'Evaluation Target' in the firm's specification table.

High Stakes New, High Stakes Classic Evaluation · Funded Varies

10% then 5%, then 10% for scaling on the funded account. A separate 8% first-step target for Classic accounts could not be confirmed on the firm's specification table, so it is not shown.

Prohibited practices
Futures Day Trade, Futures Swing Evaluation · Funded Varies

High-frequency trading, algorithmic trading and hedging are not supported and get a trader removed from the program; the FAQ adds arbitrage and trades lasting a few seconds or less.

Time limit 3
Bootcamp Evaluation · Funded Varies

'Unlimited' at every stage.

Pro Growth, Hyper Growth Evaluation · Funded Varies

'Unlimited' at every stage.

High Stakes New, High Stakes Classic Evaluation · Funded Varies

'Unlimited' at all three stages.

Every country restriction on record

The5ers does not open funded accounts for residents of at least these 36 jurisdictions, per the firm's own terms. This is not the whole list: the firm publishes further restrictions for some of its products that our record does not yet hold, so a country missing here is not a country that is allowed.

Contract findings

  1. 1.13 · Professional Account Terms

The funded program a trader bought and passed does not bind the firm. The clause lets it reassign the trader to a different Pro program than the one selected and completed, and change the terms of the assigned program "entirely", on its own risk considerations. Nothing in the clause limits the change to future trading, requires notice, or lets the trader decline and recover the fee. The parameters that made a trader choose one program over another can therefore be replaced after they have paid for it and passed it.

  2. 1.7 and 2.1(e) · Professional Account Terms

The firm may end a funded trader's access at any time without a reason, and the trader is then not entitled to any compensation. The Pro Terms do not say what happens to an accrued Reward Balance on a no-reason termination; 2.1(e) reads as excluding any payment, and 6.1 adds that "all undistributed Rewards are at risk of loss".

  3. 3.3 · Professional Account Terms

Every payout on a funded (Pro) account needs the firm's approval, given in its reasonable discretion, and the Pro Terms state no ground on which approval can be refused and no time within which it must be decided. The seven-business-day disbursement figure in the same clause is expressed as what "generally" happens. The clause then excludes all liability for any failure or inability to pay on time, "notwithstanding anything to the contrary", so a late payout carries no remedy under the contract.

  4. 4.4 · Professional Account Terms

If the firm, in its sole discretion, believes a Pro User has done any of a long list of things, including publishing "harmful content" about the firm or publishing their own email correspondence with it, it may close the account and the trader must return every Reward already received, forfeit the accrued Reward Balance, accept a permanent ban and indemnify the firm, including its attorneys' fees. This goes further than forfeiting unpaid profit: it reaches money already paid out, with no time limit and no link between the Reward and the conduct. The trigger list also includes deviating from "the trading characteristics used during the Evaluation stage", which is not defined.

  5. Client Verification Process · Terms and Conditions

A video interview can be demanded at any point and the entire relationship ends if it is not both scheduled and completed inside five business days. The penalty is triple: pending payouts denied, ALL associated accounts cancelled, and the collaboration terminated. No grounds for requesting an interview are stated and no standard for passing one is given, so a trader cannot know what triggers it or what satisfies it. Ordinary life – illness, travel, a work commitment, an email that lands in spam – is enough to lose a funded account and the money already earned.

  6. Prohibited Jurisdictions · Terms and Conditions

Residency is self-declared at signup and verified at KYC, which is deliberately after money has been taken. Discovery at any stage – including after the trader has passed and accumulated profit – cancels the account, forfeits every fee paid, voids all accrued profit, and extracts a waiver of any future claim. The firm holds a 31-jurisdiction list; the trader holds a checkbox. Because the check happens after payment rather than before it, a resident of a forbidden territory can pay, trade, pass, and only then be told none of it counted.

  7. Termination for Cause · Terms and Conditions

One of the Termination for Cause grounds, and one of the few that spells out its own consequence rather than relying on the section's general remedy. The trigger is any "defamatory, disparaging, or harmful statements" on any public platform, with review sites named. Defamation is already unlawful and needs no clause; what the clause adds is "disparaging" and "harmful", neither defined and neither requiring the statement to be untrue, so an accurate account of a poor experience is inside it. The second sentence bans the trader from publishing their own correspondence with the firm – emails, chat logs, support tickets they are a party to – which removes the material a trader would need to substantiate a complaint to anyone. The consequence is immediate termination, no refund of any fee, and forfeiture of accrued profits and the Reward Balance. Recorded at critical because the penalty is the trader's money and the trigger is lawful speech; the identical clause is recorded against Trade The Pool, which shares this operator and this Terms structure. The right-of-reply letter of 5 September 2026 covered different findings. This clause was put to the firm separately on 19 September 2026 and no reply on the merits has been received.

  8. 3.1 · Professional Account Terms

The split advertised on a program page is one of two ways the split can be set. The other is the firm's discretion, based on its own risk assessments, and the clause does not say which applies when, or whether the discretion can only improve the trader's split. The advertised split is therefore not a term the trader can hold the firm to.

  9. 4.3 · Professional Account Terms

After 60 consecutive days without a trade, the firm may close a funded account "with or without notice". The trader then has 90 days to claim the remaining Reward Balance, after which it is forfeited. Because notice of the closure is optional, the 90-day claim window can run out before the trader knows the account was closed.

  10. Confidentiality · Terms and Conditions

Confidential Information is defined to include the firm's 'metrics' and 'feedback' made available to the user. Feedback and metrics on the Hub are, in practice, what the firm tells a trader about their own account: why a breach was called, how a drawdown was computed, what the risk desk said. Defining those as the firm's confidential property means a trader who posts the explanation they were given, to ask other traders whether it is right, is disclosing Confidential Information without consent. The clause has no time limit and no survival carve-out for information the user already knew or that is public. Read with the disparagement clause in Termination for Cause, which separately bans publishing support tickets and private communications, the effect is that the contract restricts a trader's ability to publish the firm's account of its own decision, and it is that account which would be the evidence in any dispute.

  11. Definitions, Forbidden Territory; Introduction · Terms and Conditions

Israel appears on the firm's own Forbidden Territory list, and the firm is registered in Israel with an Israeli registered office at 2 Ha'tidhar street, Raanana. A trader resident where the company is incorporated cannot use it. This is not an error in the reading – the same document carries both, and the country list repeats later in the Terms with Israel in it again. It is recorded because the reason is not stated anywhere in the document: whether it reflects Israeli regulation of retail CFD offerings, a payment-rail constraint, or something else is not disclosed, and a reader is left to guess.

  12. Definitions, Trading; Services, Trading Platform · Terms and Conditions

The defined term Trading is simulated, without stage qualification. The Evaluation section says separately and explicitly that Evaluation trading is simulated and the funds fictitious, but the Definitions carry the simulation into the capitalized term used throughout the document, including the Trading Platform clause that governs the platforms a Professional User trades on. Our own package has until now recorded the funded stage as 'unknown' rather than claiming it is simulated. On the Terms as read, the capitalized term the contract uses for what a user does on a platform is defined as simulated everywhere it appears. The firm does not state anywhere in this document that the Professional User stage is different, and the Professional User section says the firm may decline to execute a user's positions, which reads consistently with an environment where the user's instruction and the firm's market action are separate things.

  13. Governing Law; Jurisdiction · Terms and Conditions

Israeli law governs and the courts of Tel Aviv have exclusive jurisdiction, for a product sold worldwide on fees of $19 to a few hundred dollars. The cost of appearing in Tel Aviv exceeds any realistic claim by a wide margin, and the liability cap caps that claim at $100 in most cases, so the two clauses together make litigation uneconomic by construction. Two further points make this worth recording rather than treating as boilerplate. First, the firm also operates through an England and Wales registration with a London office named in the same document, and the forum clause points at neither that entity's home courts nor any court in the buyer's country. Second, Israel is on the firm's own Forbidden Territory list, so the chosen forum sits in a jurisdiction whose residents the firm refuses to serve. Scoped to the Terms as read on 2026-09-15: there is no arbitration clause, no class action waiver and no contractual limitation period anywhere in the document.

  14. Introduction · Terms and Conditions

Two separate legal entities share one name across two jurisdictions, and the Terms bind the user to both without saying which contracts for what. legalName is recorded as Five Percent Online Ltd and hqCountry as GB, because the England and Wales registration is named first and carries the London office – but that is a recording decision, not a statement that the UK entity is the counterparty. A trader pursuing a claim would need to establish which entity holds the obligation, and the document does not tell them.

  15. Limitation of Liability · Terms and Conditions

The firm's total exposure for any claim is the greater of one month of fees paid or $100. Fees on this firm are small by design – the High Stakes entry rung is $19, Bootcamp entry is $22, Pro Growth $5K is $52 – so for most traders the cap resolves to $100. The cap is written to cover claims in contract and in tort and is not carved out for the firm's own forfeiture powers, so a trader disputing a forfeited profit balance, a canceled account or a denied payout faces a recovery ceiling that is smaller than the sums those clauses can take. The preceding clause separately excludes all indirect, incidental, special, punitive, exemplary and consequential damages, including lost profits.

  16. Modification of Terms · Terms and Conditions

No notice, no notification, no version history offered to the trader – the obligation to detect a change is placed entirely on them, before each use. The document read here is stamped 16 August 2026, so it does change. Combined with the forfeiture clauses above, a rule a trader is held to can appear between one session and the next.

  17. Payment Terms · Terms and Conditions

An approved payout above an undisclosed threshold is paid out in weekly installments capped at $10,000 each. The Payout Threshold is set by the firm at its sole discretion, is not published in the Terms or on any program page we hold, and may be amended at any time, so a trader cannot tell in advance whether their payout will be paid in one transfer or spread across weeks. The firm's own scaling ladders make this reachable rather than theoretical: the High Stakes table shows a $10,000 fixed payout at the $500,000 rung and $4,000 fixed payouts from $350,000 up, and the Bootcamp ladder runs to $200,000 payout ratios at $4M. A $60,000 approved payout is six weeks of installments at the cap. The clause is drafted as an installment right, not as a deferral for cause, so nothing in it requires a reason.

  18. Refund · Terms and Conditions

The Terms give a five day window for a cash refund on an untraded account. The firm's own FAQ, in the entry headed 'What Is the Cancellation and Refund Policy?' dated 2026-08-10 and read 2026-09-15, states 'Evaluation Programs: Refund available only if no trades have been placed within 14 days of purchase' and that refunds are processed to the original payment method in five to seven business days. The two surfaces give different answers to the same question: fourteen days and cash, against five days and cash then Hub Credit only. The Terms are the later document by six days and the Terms' own Order of precedence clause resolves the conflict against the buyer: 'In case of any conflict between the content on the Website and the Terms, the Terms shall prevail.' A trader who reads the help center, waits ten days and then asks for their money back is inside the published FAQ window and outside the contractual one.

  19. Refund; Services, Hub Credits · Terms and Conditions

The document uses one word, refund, for two different things. Inside five days it means money returned. After five days it means Hub Credit, which the same document defines as not real currency, of no monetary value, and not withdrawable or transferable. The second is not a refund in any ordinary sense: the buyer's money stays with the firm and they receive a token spendable only on more of the firm's own products. The Hub Credits section adds that the firm 'is not obligated to allow Users to exchange User's Hub Credits for anything of real value' and that 'Hub Credits are not refundable, all payments for Credit Hub are final'. A renderer that reports this firm as offering refunds, without the five day cliff and the change of currency, tells the buyer the opposite of what the contract says.

  20. Services, Hub Credits · Terms and Conditions

Converting earned rewards into Hub Credits is a one way door. The contract states the conversion cannot be reversed into fiat, that the firm alone decides what credits can be spent on, and that it is under no obligation to let a user exchange them for anything of real value. The firm also sets the validity period of credits, so a balance can expire, and may 'implement changes to Hub Credits at any time' in its sole discretion. Our payout policy for High Stakes already records that the firm charges 3.5 percent on every cash payout and nothing on a payout taken as Hub Credit, which is a live incentive to take the irreversible option. The credit route is presented on the firm's surfaces as the cheaper one; the contract is where it is priced.

  21. Services, Professional User · Terms and Conditions

Everything a buyer is paying for sits in the Professional User stage: the funded account, the profit split, the payouts. The Terms say that stage is governed by a further agreement, the Professional Account Terms. That agreement is not linked or shown before purchase, and it is not attached to, summarized in, or named by the Terms: the Trader Hub presents it as a click-to-sign contract once a trader is accepted. The buyer accepts the Terms and pays the Evaluation fee without being shown the document that will govern the money. The Terms also state, in the same section, that passing does not guarantee an offer, so completing the first contract does not guarantee the trader is ever shown the second. Scoped to the Terms and Conditions stamped 'Last update – Aug. 16th 2026' as read on 2026-09-15: no copy of, and no link to, the Professional User terms appears in that document.

  22. Termination rights, Termination for Cause · Terms and Conditions

Two things are bundled into one ground. The second is a chargeback, which is a common prop firm term. The first is wider: lodging an 'unjustifiable complaint regarding the paid fee' is itself a termination ground, and the contract gives no definition of unjustifiable and no process for deciding it, so the firm judges whether the complaint against it was justified. The consequence is not only termination but a permanent refusal of future service. Read with the Refund section, a buyer who believes they qualified for a refund and was wrongly refused has no safe route to press the point: escalating to their bank is expressly a termination ground, and complaining to the firm is one too if the firm decides the complaint was unjustified.

  23. Termination rights, Termination for Cause · Terms and Conditions

Three of the termination grounds turn on the firm's state of mind rather than on anything established. A reasonable belief that the user has been accused of an offence is enough, and the clause expressly counts market rumors as a basis for that belief. Separately, a suspicion of a conflict of interest, or a belief that the user is 'involved with a competing company', is its own ground. Involvement with a competing company is not defined and is a live risk for the population this product is sold to: working at another prop firm, writing about them, or holding an affiliate link could all be said to fall inside it. None of these grounds carries the ten business day cure period the general breach ground carries, and none requires the firm to disclose the rumor or the suspicion to the person it is terminating.

  24. Termination rights, Termination for Cause (closing paragraph) · Terms and Conditions

The rules whose breach terminates an account may change at any time, with or without notice, and the user carries the whole burden of keeping up. The detail is then pushed to a FAQ URL, which is help content: it is unversioned, undated as a whole, and carries no change log, so a trader cannot establish what the rules were on the day they traded, and neither can we. This matters more here than the wording suggests, because our own capture of the FAQ knowledge base found the answers are rendered by JavaScript, so even a preserved fetch of that page returns no rule text. The clause makes a moving, unrecorded target enforceable by termination. Note the contrast with the fee and parameter clause in the Evaluation section, which does protect purchases made before a change; nothing equivalent protects a trader against a mid-account change to the Trading Rules.

  25. Termination rights, Termination for Cause, Trading Rules · Terms and Conditions

The Trading Rules list eighteen specific prohibitions and then two catch-alls that swallow the specificity. The first makes a breach out of trading in a way that gives the firm 'justified concerns that the Company might suffer financial or other harm' – which is to say, winning in a way the firm finds expensive. The second leaves it to the firm's sole discretion whether a strategy is 'uncommercial' or 'not a viable trading strategy', with no standard and no appeal. Breach of the Trading Rules is a Termination for Cause ground, and the Termination section carries no cure period for it. A trader cannot read the specific list and know they are compliant, because the general words reach further than the list.

  26. Use of Automated Trading Software · Terms and Conditions

Two restrictions, and the second is absolute. Any automated trading software needs written approval in advance, granted at the firm's sole discretion with no stated criteria and no stated response time. Then, whatever the approval position, software owned or developed by anyone other than the user is prohibited outright, which rules out every purchased, licensed, free or open source expert advisor. The user also indemnifies the firm against intellectual property claims arising from their own software and bears all costs of it, and the firm may require advance testing at its discretion. This sits alongside the Trading Rules, which separately prohibit expert advisors 'from a provider where the trader does not own the source code', so the same restriction appears twice by two routes and breach of it is a Termination for Cause ground.

  27. Account, Address Changes · Terms and Conditions

A deeming clause on its own is unremarkable. It is recorded because of what it is attached to on this firm. The Terms give a trader five business days from the date of an interview request to both schedule and complete a video interview, and failing that window denies pending payouts, cancels all associated accounts and ends the collaboration. This clause makes the request delivered on sending it to whatever address the firm has on file, whether or not the trader still reads it. The five day clock runs 'from the date of the request', not from the date it was read, so the two clauses together let the deadline expire before the trader has any knowledge of it. Nothing in the document requires a second channel, a read receipt, or any confirmation that a request with that consequence reached a person.

  28. Definitions, following Forbidden Territory · Terms and Conditions

The United States is not on the Forbidden Territory list, so a US resident may hold an account – but MetaTrader 5 is closed to them by MetaQuotes' own rule rather than the firm's. The firm's own platform FAQ now goes further: "Non-US clients can use MetaTrader 5, cTrader, and TradingView. US-based clients can use TradingView." and "cTrader is no longer an option for new accounts for US clients." A US trader opening a new CFD account is left with TradingView alone, which the mobile FAQ says is available to US clients through the web platform only. MetaTrader 5 is barred by the vendor; why cTrader was withdrawn is not stated. Recorded as signup_restricted rather than signup_prohibited: the firm does not refuse US residents, it limits what they can trade on.

  29. Registration Process, Personal Use and Billing; Establishing an Account · Terms and Conditions

The account, the card and the withdrawal destination must all be in the same personal name, and no company or other legal entity may register. This is an ordinary anti money laundering posture, and it is recorded because the practical consequence is sharper than the wording. The firm's own FAQ, read 2026-09-15, states there are 'strictly no exceptions', that a payment made on a card in another name results in the account being disabled, and that the details cannot be corrected after the fact: 'we are required to refund the payment to the original card, and the account will remain disabled.' A trader who pays on a partner's or parent's card, which is common at these price points, loses the account rather than being asked to fix it. The Terms themselves state only that this 'may result in suspension', which is the softer of the two descriptions.

  30. Services, Evaluation · Terms and Conditions

The firm may change prices and, more importantly, the parameters for passing – profit targets, drawdown limits, minimum days – at any time and without agreement. The second sentence is the mitigation and it is real: a change does not affect Services already purchased, so a trader mid-evaluation keeps the targets they bought. The mitigation is not complete. It is keyed to notification rather than to publication of a dated version, the Terms carry no version history, and the protection is written for the Evaluation. The Professional User stage is governed by the separate Professional Account Terms, which are not linked or shown before purchase, so this sentence does not on its face protect a funded trader's parameters. Recorded at notable rather than higher because the grandfather clause does most of the work a trader would want.

  31. Services, Evaluation · Terms and Conditions

Every trade a user makes during the Evaluation is retained by the firm, shareable with any affiliated person or entity, and handled 'as necessary' with no further consent, consultation or approval. The user is expressly not entitled to any remuneration or revenue arising from the firm's use of it. The affiliates are not named and the clause does not limit the purposes, so the data may be used commercially. The Third Party Services section is broader still and consents to the firm providing the user's identifying information to third parties who 'may be an unaffiliated company, or an affiliate of Ours, including unregulated entities'. Recorded at notable: the clause takes nothing the trader had, but a paying customer's entire order flow is licensed away for nothing in a sentence they are unlikely to read.

  32. Services, Evaluation; Introduction · Terms and Conditions

The Terms cover the Services generally, and the Introduction confirms the Services include 'proprietary trading on Contract for Difference and Futures Contract', so the futures products are inside the contract's scope. What the Terms incorporate for program parameters is a list of three CFD pages, and that list does not match what the firm sells. The futures programs, Day Trade and Swing, have their own page at the5ers.com/futures and it is not named. The Summer Plan line, which the firm's own FAQ describes with its own prices and its own scaling answer, is not named. The page the Terms cite as 'Hyper Growth' is titled Growth and presents two separate products on it, Pro Growth and Hyper Growth, with different fees and different minimum profitable day requirements, so a trader on Pro Growth is reading parameters the Terms do not name. The result is that a futures or Summer Plan buyer has no incorporated statement of the conditions they must meet to be paid, while the Terms still say the fee is forfeit if they 'fail to meet the conditions to become Professional User'.

  33. Services, Evaluation; Refund · Terms and Conditions

The Evaluation section says a user who cancels the account, or requests cancellation by email, is not entitled to a refund, and states no carve-out for an untraded account. The Refund section two pages later says a user with no trading activity may request a full monetary refund within five days of purchase. The two clauses give opposite answers to the commonest case there is: a buyer who changes their mind the next day and emails support. Nothing in the document says which clause governs, and the Evaluation clause is the one a support agent is likeliest to be quoting. Recorded because the ambiguity is the harm: the buyer cannot tell from the contract whether they have a right to their money.

  34. User Content · Terms and Conditions

Anything a user posts in the Hub community is licensed to the firm worldwide, in perpetuity, irrevocably, with the right to modify and to create derivative works, in any medium including ones that do not exist yet. The license cannot be withdrawn by deleting the post or the account, and the same section says the firm may retain User Content after an account is deleted. A trader's shared strategy, chart or written analysis therefore becomes permanently usable marketing material. The user also indemnifies the firm for claims arising from their own content. Recorded at notable because the license is broad and irrevocable but takes no money from the trader.

  35. Services, Hub Credits · Terms and Conditions

Favorable to the trader, and recorded so the package does not read as one sided. Hub Credits expire, and the firm commits to spending the soonest-expiring balance first, which is the ordering that loses the user the least. It is a small commitment and it is the only place in the document where the firm binds itself to choose the option that favours the user. Filed informational because a clause that helps traders must not be priced as a penalty.

  36. Termination rights, Termination for Cause · Terms and Conditions

Favorable to the trader, and worth recording because it is rare on this roster. Where the ground for termination is a breach of the user's general obligations, the firm must notify the breach and give ten business days to cure it before terminating. The limit of the protection should be stated with it: the cure period attaches to this one ground in the list, and the other grounds in the same section, including the Trading Rules, the disparagement clause and the five day interview window, carry immediate termination with no notice and no opportunity to cure. Filed informational because it helps the trader.
